PIAB statement on court judgement

High Court judgement in relation to challenge

The Personal Injuries Assessment Board (PIAB) has welcomed the judgement of the High Court issued today (2 June, 2022)  in a case challenging the introduction and application of the Personal Injuries Guidelines.

Today’s judgement removes uncertainty and brings greater clarity on the application of the Guidelines, and finds that their introduction was constitutional.

PIAB also welcomes the statement by the judge in the High Court judgement that he is satisfied that PIAB acted correctly and lawfully in accordance with legislation in assessing the claim involved.

The intention of the Guidelines is to provide greater consistency in awards for personal injuries.

PIAB hopes that this judgement will result in more cases being resolved through its non-adversarial claims resolution service, which removes avoidable costs and delivers fair awards, faster than litigation.
